Court of the Judiciary seek Disciplinary Counsel

The Court of the Judiciary is seeking a qualified person for the position of Disciplinary Counsel. The Court of the Judiciary is given broad powers to investigate, hear and determine charges sufficient to warrant discipline or removal of Tennessee Judges. Included within the jurisdiction of the Court of Judiciary are all appellate, trial, general sessions, probate, juvenile, and municipal judges.

The Disciplinary Counsel has the authority and duty to:

(1) Receive and screen complaints, refer complaints to other agencies when appropriate, conduct preliminary investigations, recommend to the investigative panel of the court and, upon authorization, conduct full investigations, notify complainants about the status and disposition of their complaints, make recommendations to the investigative panel on the disposition of complaints after full investigation, file formal charges subject to approval of the investigative panel when directed to do so by the investigative panel, and prosecute formal charges;

(2) Maintain permanent records of the operations of disciplinary counsel's office, including receipt of complaints, screening, investigation, and filing of formal charges in judicial discipline and incapacity matters;

(3) Draft decisions, orders, reports, and other documents on behalf of the hearing and investigative panels if directed by the court;

(4) Compile statistics to aid in the administration of the system, including, but not limited to a log of all complaints received, investigative files, and, statistical summaries of docket processing and case dispositions.

The investigation of complaints may require statewide travel.

The disciplinary counsel is not an employee of the State of Tennessee. Services and expenses including office space and the services of additional staff are compensated through a personal services contract for an amount fixed by the court.

Applicants must be licensed attorneys in Tennessee and have practiced law or held a judicial position for a minimum ten (10) years. Applicants must have a thorough knowledge of the laws of this State and a working knowledge of the court systems. Experience in reviewing judicial ethics violations or in attorney disciplinary cases is preferred.
